October 2, 2016 - Laurel Park
#16-154 Trainer, Gerald Bennett, Oldsmar, FL 34677 is fined $25.00 for not having the colors for, “Bill’s Passion”, entered to run in the seventh race at Laurel Park on October 1, 2016, after receiving a warning on (09/16/2016 ) for the same offense.

October 2, 2016 - Laurel Park
#16-155 Trainer, Nicholas Esler, Floral Park, NY 11001, having failed to pay his fine #15-188 is hereby suspended from participating in racing until said fine has been paid.

October 4, 2016 - Laurel Park
#16-153 On August 4, 2016, the Stewards received notice from the Truesdail Laboratories, Inc. that blood sample #19207, dated July 24, 2016, contained the drug clenbuterol at 136+-4 pg/ml which is in excess of the accepted LOD established by the MRC. The Stewards, having established that blood sample #19207 was taken from the horse “Struth”, owned by Fitzhugh,LLC and trained by Michael Trombetta, following the running of the seventh race at Laurel Park on July 24, 2016. The Stewards notified Mr. Trombetta that: (1) the presence of clenbuterol in the system of “Struth” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter and (3) he had the right to be represented by counsel at the hearing.
Mr. Trombetta exercised his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2, & 3)

Upon receiving conformation from Industrial Laboratories that clenbuterol was present in sample #19207 dated July 24, 2016, at a quantity level of 99.4+-2.3pg/ml. The Stewards held a hearing regarding this result on September 29, 2016 wherein Mr. Trombetta waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:

  1. “Struth” did carry clenbuterol, in its system when it finished second in the seventh race at Laurel Park on July 24, 2016, a violation under [COMAR 09.10.03.04, Section C;]
  2. Michael Trombetta, as trainer, was the absolute insurer of, and responsible for, the condition of “Struth” at the time the horse ran (Sections D & F); and
  3. A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed (Section G).

Based upon the foregoing, and in accordance with RCI recommended penalties for this drug violation,
the Stewards hereby order that:

  1. Trainer Michael Trombetta, Baldwin, MD 21013, be suspended fifteen (15) days).
  2. Trainer Michael Trombetta will be assigned two (2) Multiple Medication Violation Points.

  3. The horse “Struth”, be disqualified from the seventh race on July 24, 2016 at Laurel Park.
  4. The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance with the following order:

#16-157 On July 1, 2016, the Stewards received notice from Truesdail Laboratories, Inc. that urine sample #18886, dated June 18, 2016, contained the drug 4-methylaminoantipyrine which is not on the approved list of Controlled Therapeutic Substances for the Maryland Racing Commission. The Stewards, having established that urine sample #18886 was taken from the horse “Pagan Power”, owned by Stronach Stable, Inc. and trained by Jose Corrales, following the running of the fifth race at Laurel Park on June 18, 2016. The Stewards notified Mr. Corrales that: (1) the presence of 4-methylaminoantipyrine in the system of “Pagan Power” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.
Mr. Corrales exercised his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2, & 3)

Upon receiving conformation from Texas A&M Veterinary Medical Diagnostic Laboratory that 4-methylaminoantipyrine was present in sample #18886 dated June 18, 2016.

The Stewards held a hearing on October 6, 2016 wherein Mr. Corrales waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:

  1. “Pagan Power” did carry 4-methylaminoantipyrine, in its system when it finished second in the fifth race at Laurel Park on June 18, 2016, a violation under COMAR 09.10.03.04, Section C;
  2. Jose Corrales, as trainer, was the absolute insurer of, and responsible for, the condition of “Pagan Power” at the time the horse ran (Sections D & F); and

Based upon the foregoing, the Stewards hereby order that:

  1. Trainer Jose Corrales, Laurel, MD 20723, be fined in the amount of Five Hundred dollars ($500).
  2. Trainer Jose Corrales will be assigned two (2) Multiple Medication Violation Point.

#16-158 In the matter of trainer Jose Corrales, Laurel, MD 20723. Having been assessed one (1) point by the Maryland Racing Commission Stewards Ruling # 15-076 for a positive post- race test on January 30, 2015 and receiving two (2) additional points for a positive post- race test on June 18, 2016 by the Maryland Racing Commission Stewards Ruling #16-157, Mr. Corrales has now accumulated three (3) total points, which under “The Multiple Medication Violation Regulation” COMAR 09.10.03.02 C (6) demands a thirty (30) days of suspension.

This suspension will commence on October 15, 2016 and run through November 13, 2016.

#16-159 In the fifth race, at Laurel Park on October 2, 2016, horse #6 “Sarah’s Treasure”, ridden By jockey, Horacio Karamanos was disqualified from third position and placed eighth, behind horse #7 “Gimme Kimmy”, ridden by jockey Trevor McCarthy. Through the stretch #6 “Sarah’s Treasure”, drifted out, into the path of #5 “Tizadoozi” forcing that horse out into the path of #7 “Gimme Kimmy” causing that rider to take up sharply to avoid clipping heels.ing heels.
[Violation under COMAR 09.10.01.50, A (1) c, d & e, which states in pertinent parts: “A horse may not: (b) Cross in front of another horse without sufficient clearance, (d) Intimidate another horse, or (e) Impede another horse.]

#16-172 Trainer, Blane Servis, is fined One Hundred dollars ($100.) for, failure to follow licensing procedures, by not obtaining an owners license for Ratagues Racing Stable, Inc. owner of “Getaway Keys”, who was allowed to run, at Laurel Park, on January 3, 2015. Mr. Servis accepted responsibility of this licensing procedure by signing the affidavit permitting this entry to race.

#16-173 Trainer, Blane Servis, is fined One Hundred dollars ($100.) for, failure to follow licensing procedures, by not obtaining an owners license for Soldi Stable, LLC owner of “Getaway Keys”, who was allowed to run, at Laurel Park, on January 3, 2015. Mr. Servis accepted responsibility of this licensing procedure by signing the affidavit permitting this entry to race.

#16-176 On October 28, 2016, the Stewards received notice from Truesdail Laboratories, Inc. that blood sample #19973, dated October 15, 2016, contained a level of omeprazole sulfide found at 134+-11 ng/ml., a violation under COMAR 09.10.03.04 Drug Prohibition-Horses. The Stewards, having determined that the sample had been taken from the horse “Awake the Day” following the running of the third race at Laurel Park on October 15, 2016, notified its trainer, W. Robert Bailes that: (1) He was being charged with a violation of the drug prohibition regulation, and (2) he had the right to have the split of sample #19973 tested by an independent laboratory approved by the Commission prior to appearing before the Stewards for a hearing on this matter.

Trainer Bailes was contacted via phone October 29, 2016. He did not dispute the charges and waived all rights in this matter.

Based upon the evidence before them, the Stewards have found the following:

  1. As per COMAR 09.10.03.04, D and F, trainer Bailes was the absolute insurer of, and responsible for, the condition of “Awake the Day” at the time the horse ran;
  2. The level of omeprazole (134 ng/ml) found in the blood sample taken post-race from “Awake the Day” exceeded the permitted level of the drug (1.0 ng/ml) - a violation under COMAR 09.10.03.04, C;

Based upon the above, The Stewards issue a warning to trainer, W. Robert Bailes and he will be assigned one half (1/2) Multiple Medication Violation Point.

#16-177 Trainer, George Leonard, III, is fined One Hundred dollars( $100.00) for, not having the colors for, “Natchez Pass”, entered to run in the seventh race at Laurel Park on October 28 , 2016, after receiving a $25.00 fine on (10/21/2016) for the same offense.
