February 2, 2017 - Laurel Park
#17-006 In the matter of stable employee Eduardo Rodriguez:
On January 29, 2017 Mr. Rodriguez was requested to deliver a urine sample by the MRC Investigators. The specimen he rendered tested positive for marijuana.
COMAR 09.10.03.05 A(1)(a)(i).

A hearing was held on February 2, 2017. Mr. Rodriguez appeared in the absence of counsel and waived his right thereto. Based upon the testimony and evidence presented at the hearing, the Stewards found Eduardo Rodriguez in violation of COMAR 09.10.03.05 Drug Prohibition-Humans.

Accordingly, the Stewards hereby order:

  1. That the license issued to Eduardo Rodriguez be suspended until such time as he has been professionally evaluated [COMAR 09.10.03.05, F(1)].
  2. That while he is under suspension, Mr. Rodriguez be denied the privileges of all the grounds under the jurisdiction of the Maryland Racing Commission.

February 2, 2017 - Laurel Park
#17-007 In the matter of stable employee Cesar Lopez:
On January 29, 2017 Mr. Lopez was requested to deliver a urine sample by the MRC Investigators. The specimen he rendered tested positive for marijuana.

February 4, 2017 - Laurel Park
#17-008 Trainer, Miguel Penaloza is fined $25.00 for not having the colors
for, “Secrect Six”, entered to run in the first race at Laurel Park on January 29, 2017, after receiving a warning on (01/27/2017 ) for the same offense.
THIS IS A VIOLATION OF: [COMAR 09.10.01.09]

February 4, 2017 - Laurel Park
#17-009 In the matter of stable employee Miguel Fuentes, Jr.:
On February 3, 2017 Mr. Fuentes was interviewed by the MRC Investigators about drug use on the grounds. Mr. Fuentes admitted to marijuana use.
COMAR 09.10.03.05 A(1)(i).

A hearing was held, Mr. Fuentes appeared in the absence of counsel and waived his right thereto. Based upon the testimony and evidence presented at the hearing, the Stewards found Miguel Fuentes, Jr. in violation of COMAR 09.10.03.03 Drug Prohibition-Humans.

Accordingly, the Stewards hereby order:

  1. That the license issued to Miguel Fuentes, Jr. be suspended until such time as he has been professionally evaluated [COMAR 09.10.03.05, F(1)], and
  2. That while he is under suspension, Mr. Fuentes be denied the privileges of all the grounds under the jurisdiction of the Maryland Racing Commission. [COMAR 09.10.01.45, 'Y (1) (a).]

February 4, 2017 - Laurel Park
#17-010 The below listed licensees have been fined for failure to have the 2016-17 license badges
they had been issued by the Maryland Racing Commission. [COMAR 09.10.04.11, 'C.]

  • PRADENAS, Sergio $5.00
  • MEDEL-CARO, Francisco $5.00

February 10, 2017 - Laurel Park
#17-012 In the matter of trainer Kevin Dove
; On February 9, 2017, trainer Kevin Dove appeared before the Stewards to answer charges that he had committed a violation of COMAR 09.10.04.19 Workers’ Compensation. Trainer Dove appeared in the absence of counsel and waived his right thereto.

At the hearing, the Stewards determined that:

  1. On February 5, 2017, trainer Dove employed a stable employee to run his entry, “Im King”, in the sixth race at Laurel Park,
  2. Trainer Dove does not carry Workers’ Compensation insurance, and
  3. Maryland Racing Commission regulations, under Section A of COMAR 09.10.04.19, require that a licensee who employs one or more individuals in “a racing-related activity” carry Workers’ Compensation insurance.

Based upon the above, and in accordance with the penalties they have issued in the past for similar violations, the Stewards hereby order Kevin Dove to pay a fine in the amount of two hundred and fifty dollars ($250.00).

#17-011 Owner Four Tags Stable, having failed to pay a fee
in the amount of one thousand one hundred and sixty dollars ($1,160.00), to the Maryland Thoroughbred Purse Account, is hereby precluded from participating in racing until said fee has been paid.

#17-013 Owner Forever Tang, La Surestada Stables, Inc. and Shalom TR, having failed to pay a fee
in the amount of one thousand one hundred and fifty five dollars ($1,155.00), to the Maryland Thoroughbred Purse Account, is hereby precluded from participating in racing until said fee has been paid.

#17-014 Owner Whitehall Stable, having failed to pay a fee
in the amount of seventy dollars ($70.00), to the Maryland Thoroughbred Purse Account, is hereby precluded from participating in racing until said fee has been paid.

February 15, 2017 - Laurel Park
#17-025 In the matter of trainer Gerald Brooks
; On February 10, 2017, trainer Gerald Brooks appeared before the Stewards to answer charges that he had acted in a way that is not in the best interest of racing. Trainer Brooks appeared in the absence of counsel and waived his right thereto.

At the hearing, the Stewards determined that:

Mr. Brooks did use profane and indecent language to another licensee.

Based upon the above, the Stewards hereby order Gerald Brooks to pay a fine in the amount of five hundred ($500.00). Mr. Brooks is also suspended for a period of fifteen (15) days. This suspension is stayed under the provision, he not be involved in another altercation for the remainder of this year 2017. [COMAR 09.10.01.45,H.]

February 18, 2017 - Laurel Park
#17-026 Trainer, T. Bernard Houghton is fined $25.00 for not having the colors
for, “Our Karin Louise”, entered to run in the third race at Laurel Park on February 17, 2017, after receiving a warning on (01/14/2017 ) for the same offense.

#17-027 Asst. Trainer, Cassondra Weaver, is fined $25.00 for smoking under a shed row
at Laurel Park on February 11, 2017.

#17-028 Stable employee, Christine Dilodovico, is fined $25.00 for smoking under a shed row
at Laurel Park on February 11, 2017.

February 20, 2017 - Laurel Park
#17-029 Trainer, Neil Morris, is fined One Hundred dollars ($100.), for failure to have his entry, “Brindabella”, treated with furosemide (lasix)
three hours before post time for the second race at Laurel Park on February 20, 2017.

February 23, 2017 - Laurel Park
#17-030 In the ninth race, at Laurel Park on February 19, 2017, horse #4 “Mine the Cape”, ridden by apprentice jockey, Jenn Miller was disqualified
from second position and placed third, behind horse #3 “Seven Knots”, ridden by jockey Trevor McCarthy. Inside the 1/8th pole, #4 “Mine the Cape” came over into the path of #3 “Seven Knots”, crowding that horse and forcing the rider to alter course.

[Violation under COMAR 09.10.01.50, A (1) d & e , which states in pertinent parts: “A horse may not: (d) Intimidate another horse, or (e) Impede another horse.]
