Mr. Brian Cavey called the Council meeting to order at 9:04 a.m. at Delaware Elevator, Inc., 2007 Allen Drive, Salisbury, Maryland 21801 and welcomed all Council members, staff and guests in attendance. He thanked Delaware Elevator, Inc. for their hospitality in hosting the Council meeting. Pete Meeks, the owner of Delaware Elevator, welcomed the meeting to their training center and thanked the Council for everything that it does for training in Maryland and expressed his gratitude for how apprenticeship has benefited his company. Mr. Cavey welcomed Erin Roth, Deputy Assistant Secretay for the Division of Workforce Development and Adult Learning and Pat Schrawder from the office of Senator Mary Beth Carozza and thanked both of them for attending the Council meeting.

I. The first order of business was the approval of the minutes of the March 12, 2019 Maryland Apprenticeship and Training Council meeting. The minutes of the March 12, 2019 Council meeting were approved as submitted.

II. DIRECTOR’S REPORT:

A. Mr. MacLarion thanked everyone for attending the Maryland Apprenticeship and Training Council meeting. He noted that Acting Secretary James Rzepkowski was not able to attend the Council meeting due to another committement elsewhere in the state and thanked Erin Roth, Deputy Assistant Secretary for the Division of Workforce Development and Adult Learning, for attending. He stated that effective July 1st the name of the department had changed from the Maryland Department of Labor, Licensing and Regulation to the Maryland Department of Labor. He informed Council members that effective July 3rd Employer Representative Edwin Cluster had resigned from his position on the Council and expressed his gratitude for all that Mr. Cluster has done for apprenticeship in Maryland during his twelve years of service.

B. Council members were provided with an update of the status of the Apprenticeship and Training Fund. Mr. MacLarion reported that the balance as of June 30, 2019 after all obligations was $756,245.95. Contributions coming into the fund were $18,478.07 for the month of May 2019 and $17,639.80 for the month of June 2019.

C. At the May 14, 2019 Council meeting, Mr. MacLarion had reported that Maryland was preparing an application to submit to the U.S. Department of Labor for the next round of State Apprenticeship Expansion Grants. He announced that he had received notification from the U.S. Department of Labor that the grant applicaton had been approved and that based upon performance under the prior two grants, the amount awarded to Maryland had been doubled to $2.8 million. Maryland was one of only four states that had received more funding than had been requested. The grant is effective July 1, 2019 and has a performance period of three years.

D. Council members were informed that in June, the U.S. Department of Labor had issued a Notice of Proposed Rulemaking for a new type of Industry-Recognized Apprenticeship Progams and gave an overview of these. He added the Mr. Cavey would be speaking more regarding these at a later point in the meeting.

E. Mr. MacLarion updated Council members on progress being made to resolve the issue of apprentices not being able to be entered in RAPIDS in more than one state where registration is needed in more than one state to satisfy State Prevailing Wage requirements.

F. Youth Apprenticeship, now Apprenticeship Maryland, is continuing to expand and with the addition of Baltimore County. There are now twelve school systems that are participating.

G. Mr. MacLarion stated he had been asked make sure that the Council was aware of changes that the Maryland Board of Heating, Ventilation, Air Conditioning and Refrigeration Contractors had made to the application process for applying to take their licening examinations.
H. Mr. MacLarion informed the Council that Ronald Leonard of the U.S. Department of Labor Office of Apprenticeship was not able to be in attendance at the Council meeting due to a death in his family. He asked that everyone keep him in their thoughts at this time.

Mr. Cavey stated that Industy-Recognized Apprenticeship Programs had been a major topic at the recent meeting of the National Association of State and Territorial Apprenticeship Directors (NASTAD) which he had not been able to attend. In a conference call of State Apprenticeship Council chairpersons, much of the conversatation also centered around those programs. Concerns centered around for profit career education. While that system might generate some decent Industry-Recognized Apprenticeship Programs, given the history of for profit career education programs, it makes it clear that a combination of federal funding, a captive quality assurance system and weak accountability measures creates a risk to the quality of these programs for students, employers and taxpayers.

III. NEW BUSINESS:

A. NEW PROGRAMS:

1. Fire & Life Safety America, Inc. (John F. Vontran) –Occupations of Sprinkler Fitter and Quality Control Technician. Related instruction to be provided in-house. Request for registration of an Affirmative Action Plan with apprentice selection procedures and goalS and timetables for minority and female apprentices.

Mr. MacLarion presented this request for registration of Standards of Apprenticeship to the Council and introduced Joey Collins and Heidi Darmour who were in attendance representing Fire & Life Safety America, Inc.

A motion to approve this request for registration of Standards of Apprenticeship was made by Ms. Butt, seconded by Mr. Smarte and unanimously approved.

A motion to approve the Affirmative Action Plan with apprentice selection procedures and goals and timetables for minority and female apprentices was made by Mr Bromley, seconded by Mr. Smarte and unanimously approved.

2. Humanim, Inc. (Jeffrey W. Smith) – Occupation of Direct Support Professional. Related instruction to be provided as stated in Appendix B. Request for registration of an Affirmative Action Plan with apprentice selection procedures and goals and timetables for minority and female apprentices.

Jeffrey Smith presented this request for registration of Standards of Apprenticeship and introduced Henry Posko and Judi Olinger who were in attendance representing Humanim, Inc.

Mr. Bromley questioned the statement in the minimum qualifications for apprenticeship that applicants for the apprenticeship program be Maryland residents. Ms. Olinger responded that most of their employees reside in the Central Maryland area but they would be open to expanding the program to residents of other areas.

Mr. Klusmann questioned the qualification that applicants have a valid drivers license. Ms. Olinger replied that that was necessary as part of the work of a Direct Support Professional involves transporting clients.

A motion to approve this request for registration of Standards of Apprenticeship with a change to make the residency requirement be not applicable was made by Ms. Butt, seconded by Mr. Shmelzer and unanimously approved.

A motion to approve the Affirmative Action Plan with apprentice selection procedures and goals and timetables for minority and female apprentices was made by Mr. Bromley, seconded by Mr. Smarte and unanimously approved.

3. Salco Mechanical Contractors (Christopher D. MacLarion/John F. Vontran – Occupation of Plumber. Related instruction to be provided by Fairfax County, Virginia Public Schools Adult and Community Education.

Mr. MacLarion presented this request for registration of Standards of Apprenticeship to the Council and introduced Stephen Exelbert who was in attendance representing Salco Mechanical Contractors.

A motion to approve this request for registration of Standards of Apprenticeship was made by Mr. Smarte, seconded by Mr. Bromley and unanimously approved.

B. PROGRAM REVSIONS:

1. I.E.C. Chesapeake, Inc. (Chrisopher D. MacLarion/John F. Vontran) – Request to revise Standards of Apprenticeship for the sole purpose of changes and additions to Section 6- Qualifications for Apprenticeship.

Employer Representatives Leon Bromley and Grant Shmelzer recused themselves from the consideration of this item of Council business.

A motion to approve this revision was made by Mr. Smarte, seconded by Mr. Klusmann and approved with four (4) Council members in favor of the motion, one (1) Council member opposed and two (2) abstentions.

2. Tate Engineering Systems, Inc. (John F. Vontran) – Revision to add the Heating and Air Conditioning Contractors of Maryland, Inc. as a related instruction provider for all locations.

This revision was postponed to the September 10, 2019 Council meeting in order for a representative of the sponsor to be in attendance at that meeting.

C. PROGRAM REVIEWS (Fewer Than Five (5) Apprentices):

1. The following program reviews had been performed and the programs were found to be conducted in a satisfactory manner. [No Council Action Required]:

a. Harford County Maryland Joint Apprenticeship Committee (Kelton Addison) – Occupations of Plumber, Electrician and HVACR Technician.

b. McLane Foodservice Distribution, Inc., Aberdeen (Kelton Addision) – Occupation of Truck Driver, Heavy.

c. Washington County Department of Water Quality (Jennifer D. Runkles) – Occupation of Senior Wastewater Treatment Operator.

d. G.A. Smith Electric, Inc. (Jane Sinclair) – Occupation of Electrician.

e. St. Mary’s County Sheriff’s Office (Jane Sinclair) –Occupation of Deputy Sheriff – Law Enforcenent.

f. Baltimore City Community College (John F. Vontran) - Occupation of Industrial Maintenance Technician.

g. Baltimore Police Department (John F. Vontran) – Occupation of Police Cadet.

h. Howard County Government Joint Apprenticeship Committee (John F. Vontran) – Occupations of Electrician, HVACR Technician and Plumber.

D. VOLUNTARY REQUEST FOR CANCELLATION OF STANDARDS OF APPRENTICESHIP:

1. Maryland Burglar and Fire Alarm Association effective April 5, 2019.

A motion to approve the request for volunary cancellation of Standards of Apprenticeship for the Maryland Burglar and Fire Alarm Association effective April 5, 2019 was made by Mr. Klusmann, seconded by Mr. Smarte and unanimously approved.

E. OTHER BUSINESS:

1. Associated Builders and Contractors, Inc., Cumberland Valley Chapter (John P. Taylor) – Request to register an apprentice HVACR Technician with credit for one-the-job training and related instruction beyond the fifty percent (50%) level.

A motion to approve this request was made by Mr. Shmelzer, seconded by Mr. Smarte and unanimously approved.

2. Request for Allegany College of Maryland to be an eligible employer for Apprenticeship Maryland (Youth) (Jennifer D. Runkles).

A motion to approve this request was made by Mr. Shmelzer, seconded by Mr. Wilford and unanimously approved.

3. Request for the approval of Cambridge International/Rexnord to be an eligible employer for Apprenticeship Maryland (Youth) (Patty Shreves).

A motion to approve this request was made by Mr. Bromley, seconded by Mr. Shmelzer and unanimously approved.

4. Request for the approval of Campbell’s Boatyard to be an eligible employer for Apprenticeship Maryland (Youth) (Patty Shreves).

A motion to approve this request was made by Mr. Smarte, seconded by Mr. Bromley and unanimously approved.

5. Request for the approval of Fisherman’s Inn to be an eligible employer for Apprenticeship Maryland (Youth) (Patty Shreves).

A motion to approve this request was made by Mr. Bromley, seconded by Mr. Wilford and unanimously approved.

6. Request for the approval of GKD-USA, Inc. to be an eliglble employer for Apprenticeship Maryland (Youth) (Patty Shreves).

A motion to approve this request was made by Mr. Bromley, seconded by Ms. Butt and unanimously approved.

7. Request for the approval of Willard Agri Service to be an eligible employer for Apprenticeship Maryland (Youth) (Patty Shreves).

A motion to approve this request was made by Mr. Bromley, seconded by Mr. Shmelzer and unanimously approved.

8. Request for the approval of Altimate Electric, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).

A motion to approve this request was made by Mr. Shmelzer, seconded by Mr. Klusmann and unanimously approved.

9. Request for the approval of DEL Electric to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W.Smith).

A motion to approve this request was made by Ms. Butt, seconded by Mr. Bromley and unanimously approved.

10. Request for the approval of Grounded Electrical Construction to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).
A motion to approve this request was made by Mr. Bromley, seconded by Mr. Klusmann and unanimously approved.

11. Request for Humanim, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) ( Jeffrey. W. Smith).

A motion to approve this request was made by Mr. Smarte, seconded by Mr. Klusmann and unanimously approved.

12. Request for the approval of R.E. Newcomb, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).

A motion to approve this request was made by Mr. Bromley, seconded by Ms. Butt and unanimously approved.

13. Request for the approval of Rommel Construction, LLC to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).

Employer Representative Leon Bromley recused himself from the consideration of this item of Council business.

A motion to approve this request was made by Mr. Shmelzer, seconded by Mr. Suite and approved with five 5) Council members in favor of the motion, none opposed and one (1) abstention.

14. Request for the approval of Salon Tusey to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).

A motion to approve this request was made by Mr. Smarte, seconded by Mr. Klusmann and unanimously approved.

15. Request for the approval of Teamworx Security, LLC to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).

A motion to approve this request was made by Mr. Bromley, seconded by Mr. Shmelzer and unanimously approved.

16. Request for the approval fo Windsor Electric Company, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).

A motion to approve this request was made by Mr. Bromley, seconded by Mr. Shmelzer and unanimously approved.

There being no further business to come before the Council, the meeting of the Maryland Apprenticeship and Training Council was adjourned at 10:20 a.m.
